Serenitas Calendar Photography Competition Terms and Conditions

 1. General
1.1. The Promoter is Serenitas Management Pty Ltd ABN 96 623 197 688, located at Level 36, 60 Margaret St, Sydney NSW 2000.
1.2. By entering this Competition, Entrants agree to be bound by these Terms and Conditions. Information on how to enter and prizes form part of these Terms and Conditions.

2. Eligibility
2.1. Entry is open only to Serenitas staff members or homeowners in a Serenitas community who have personally taken the photograph(s) they intend to submit.
2.2. This competition will be conducted during the Entry Period: 14.08.24 to 5:00 PM (AEST) on 20.09.2024. Entries must be received by the Promoter during the Entry Period. Entries received after the Entry Period will not count towards the Competition. The Promoter is not responsible for any late, lost, misdirected entries, or corrupt digital files.

3. Entry
3.1. To enter this Competition, Entrants must complete the entry form, including contact details, and submit up to 3 images via the website [www.serenitas.com.au/calendar2025](http://www.serenitas.com.au/calendar2025), with 1 entry per person per sport/activity.
3.2. Entry to this Competition via [www.serenitas.com.au/calendar2025](http://www.serenitas.com.au/calendar2025) is free.
3.3. Entries may also be submitted:
a) via the webform at [www.serenitas.com.au/calendar2025](http://www.serenitas.com.au/calendar2025), or
b) electronically to the Serenitas Marketing team at marketing@serenitas.com.au (up to 18MB per email).
3.4. The entry submitted must be an original photograph that does not infringe on the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal, or proprietary rights.
3.5. Entrants must ensure they have the necessary talent release forms signed for everyone that appears in the entry, and winning entrants may be requested to provide written evidence of these signed documents.
3.6. To be eligible to enter the competition, the photograph(s) must be in a high-resolution format at 300dpi (ensure your camera is set to the highest quality) so they can be reproduced for high-quality print and be in line with the theme of “Game On!”
3.7. To be eligible to win a prize in this Competition, an Entry must not:
3.7.1. Infringe the intellectual property or other rights of a third party;
3.7.2. Be incomplete or illegible; or
3.7.3. Be unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive, or otherwise contain content which, in the Promoter’s sole discretion, is inappropriate or objectionable.
3.8. The Promoter reserves the right to verify the validity of an Entry and to disqualify an Entrant for tampering with the entry process or for submitting an Entry that does not, in the Promoter’s sole discretion, comply with these Terms and Conditions.
3.9. Entries selected to feature in the calendar may need to be cropped to suit the size requirements of the calendar.
3.10. All entrants to the competition agree to give The Promoter the right to reproduce their image in print and online marketing material to promote awareness of Serenitas. This right is non-exclusive, and images will not be shared with any third party.
3.11. You assign ownership of the image in perpetuity to Serenitas to create and promote the calendar and the Promoter.
3.12. All Entries become the property of the Promoter.

4. Judging of Entries
4.1. This Competition is a game of skill, and chance plays no part in determining the winner. All entries will be judged individually on their merits based on how well they highlight the energy and passion of sports and activities.
4.2. Judging will take place at 12:00 PM on Monday, 23 September 2024, at the office of Serenitas Management Pty Ltd, Level 36, 60 Margaret St, Sydney NSW 2000. Entries will be judged by a panel of judges appointed by the Promoter.
4.3. The judges’ decision is final, and no correspondence will be entered into.
4.4. The Entrant who submits the best Entry (as determined by the judges) will win the Prize(s) (Winner). The judges’ decision is final, and the Promoter will not enter into correspondence regarding the results.

5. Winners
5.1. Twelve entries will be selected for inclusion in the Serenitas ‘Game On 2025’ calendar.
5.2. Winners will be notified by phone or email by 27.09.2024.
5.3. The prizes will be issued to the winners by 31.10.2024. The Promoter will not be responsible for any delay, loss, or damage to the Prize once it has left the Promoter’s or supplier’s premises.
5.4. If the Winner is unable to comply with these Terms and Conditions, the Promoter reserves the right to award the Prize to the Entrant with the next best Entry, as determined by the judges.

6. Prizes
6.1. Each winning entry will receive 1 x $50 WISH Gift Card.
6.2. There will be a total of twelve prizes of 1 x $50 WISH Gift Card to be won. The maximum total prize pool value is $600. The Promoter accepts no responsibility for any variation in the value of the prizes.
6.3. The Winner’s use of the Prize is subject to additional terms and conditions (including gift card expiry) imposed by the supplier(s) of the Prize (if any), with which the Winners must comply.
6.4. The Prize is not transferable and not redeemable for cash or other goods or services. The Prize must be taken as a whole and as stated in these Terms and Conditions. No alternative will be provided, and no compensation will be payable if the Winner is unable to use the Prize as such.
6.5. The value of the Prizes is the recommended retail price as provided by the supplier (inclusive of GST) and is correct as at the start of the Competition.
6.6. If the Prize becomes unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the Prize with a prize of equal or greater value and/or specification.

7. Your Information
7.1. If an Entrant’s contact details change after the date of entry, the Entrant must notify the Promoter of his/her updated contact details.
7.2. The Promoter is bound by the Privacy Act 1988 (Cth). Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to conduct the Competition, publicize the name of the Winners, and where Entrants have consented to the receipt of such information, send Entrants marketing, advertising, and promotional material.
7.3. Entrants’ personal information may be disclosed to third parties who assist the Promoter in conducting this Competition, including regulatory authorities, entities which supply and deliver the Prizes to the Winners, and marketing and communications agencies.
7.4. The Winners’ names will be published and retained as required by relevant legislation and as specified in these Terms and Conditions.
7.5. Entrants can contact the Promoter to request access to, or corrections of, the Entrant’s personal information held by the Promoter by email at privacy@serenitas.com.au or mail PO Box R1473, Royal Exchange NSW 1225.
7.6. The Winner consents to the Promoter’s use of the Winner’s name, likeness, image, picture, voice, statements, testimonials, or quotations for promotional, marketing, and publicity purposes in any media worldwide, without any fee being paid to the Winner.

8. Risk and Liability
8.1. To the fullest extent permitted by law, the Winner participates in this Competition and uses the Prize at his or her own risk.
8.2. To the fullest extent permitted by law, the Promoter, its related bodies corporate, and the suppliers, agencies, and other companies involved in this Competition assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data.
8.3. If this Competition is not capable of running as planned for any reason (including as a result of technical failures, fraud, or causes beyond the Promoter’s control), the Promoter may, in its sole discretion, cancel, suspend, or change the Competition and re-commence it on similar terms, subject to any directions by regulatory authorities.
8.4. To the fullest extent permitted by law, the Promoter, its related bodies corporate, and their respective officers, directors, employees, and agents exclude liability for all loss (including loss of data, unauthorized access to data, and consequential loss), damage, expenses, death, or personal injury suffered or incurred arising out of, or in connection with, this Competition (including in relation to the Winner’s participation in this Competition and use of the Prize).
8.5. These Terms and Conditions are governed by the laws of the State of New South Wales.
